RMD Keeper

Terms of Service

Effective 16 September 2026. These terms are between Jayanas LLC, a Nebraska limited liability company ("Jayanas", "we"), and the organisation that opens an account ("you").

1. The service

RMD Keeper (the "Service") reads the public FCC Robocall Mitigation Database each night, tells you when your listing or a listing you watch changes or disappears, tracks filing deadlines, generates a robocall mitigation plan and filing copy sheet from answers you give, and keeps a log of traceback requests and evidence you choose to upload. Any other engineering work we do for you is covered by a separate written statement of work.

2. Your account

You must give accurate details, keep your sign-in credentials private, and tell us promptly at support@jayanas.com if you believe an account has been misused. You are responsible for everyone who uses the Service under your account.

3. Your obligations stay yours

You are the voice service, gateway or intermediate provider. Your FCC registration, your CORES credentials, the content and truthfulness of everything you file with the FCC, the operation of your robocall mitigation program, your responses to tracebacks, and every duty under 47 CFR Part 64 and the TRACED Act remain your responsibility. The Service prepares documents and information to help you meet them; it does not file on your behalf and does not take them over. Generated plans reflect your answers; you must read them before filing. Nothing we provide is legal advice.

4. Alerts and public data

Alerts are derived from the FCC's public listing as it appeared when we read it. The FCC can change the listing, its format or its availability at any time. We make reasonable efforts to read it every night and to tell you when we cannot, but we do not guarantee that every change will be detected or detected on a particular day, and you should verify any removal directly with the FCC before acting on it.

5. Data and security

We store the information the FCC publishes about providers, your plan answers, your partner list, deadlines, traceback log entries and any evidence files you upload. Files are stored in private, encrypted object storage in the United States. You agree not to upload call detail records, subscriber lists, customer identity documents or other personal information about your customers or end users; the Service is designed so that we never hold it. We keep your records for the term of your account and for two years afterwards, matching the FCC's two-year look-back on regulatory history, unless you ask us to delete them sooner.

6. Fees

Plans are billed monthly in advance at the price shown when you subscribe, plus any applicable taxes, after a free trial of fourteen days. You can cancel at any time and the cancellation takes effect at the end of the paid month. Prices for an existing plan change only with thirty days' written notice.

7. Availability

We monitor the Service continuously but do not promise a particular uptime during its first year. The FCC portal and database are outside our control.

8. Acceptable use

You may use the Service only for your own compliance, or, on a Firm plan, for the compliance of the providers you are engaged to assist. You may not resell it, probe or disrupt it, or use it to originate, facilitate or conceal illegal robocalls. We may suspend an account immediately if we believe it is being used by or for a provider engaged in illegal calling.

9. Intellectual property and feedback

We own the Service and everything in it except your data. You own your answers, the plans generated from them, and the files you upload. Feedback you give us may be used to improve the Service without any obligation to you.

10. Liability

To the fullest extent permitted by law, our total liability for any claim connected with the Service is limited to the fees you paid us in the twelve months before the claim arose, and neither party is liable for indirect, consequential or punitive damages, for regulatory forfeitures, or for loss of traffic or revenue resulting from a removal from the Robocall Mitigation Database. Nothing in these terms limits liability for fraud or for anything that cannot be limited by law.

11. Termination

Either party may end the account with thirty days' written notice. We may suspend the Service immediately if it is being misused or if fees are unpaid after notice. On termination we will provide an export of your plan, log and evidence and then delete your data according to section 5.

12. General

These terms are governed by the laws of the State of Nebraska, and the state and federal courts in Sarpy County, Nebraska have exclusive jurisdiction. If we change these terms we will give you thirty days' notice by email; continued use after that date is acceptance. If any part is unenforceable the rest still applies. Questions go to support@jayanas.com.
